ORDER
For quite sometime it is being experienced that not only the number of inspections done by ILM Grade-I, Grade-II and Grade-III have decreased but the quality of inspections have also decreased with a few exceptions. So much so that ILMs are not taking seriously inspection to check accuracy of Weights, Counter scale, Electronic Balances etc. and are not checking the contents in the packages, which are the most important functions of the department.
Henceforth, it is decided that main emphasis shall be given to above fields and checking of packages under the Standards of Weights & Measures (Packaged Commodities) Rule, 1977 shall be done only by ILM Grade-I or by the Enforcement Staff.
From now onwards the ILMs shall meet targets as per details given below:
- Zonal Officers of all Zones will conduct at least 4 inspections in a month of the Establishments of manufacturers/packer of Packaged Commodities to check the contents in the finished packaged products. The inspection will be carried out as stipulated in the Standards of Weights & Measures (Packaged Commodities) Rule, 1977 by associating at least one inspector Grade-II or Grade-III of the Zone.
- Inspections of packaged commodities henceforth will be made by a team of inspectors deployed from Enforcement Branch or by Zonal Officers. The establishment dealing in packaged commodities so inspected must be a whole seller / Retailer having Sales Tax Registration number. The inspector booking an establishment for violation of P.C.R must obtain at least an empty package to substantiate the case or leave the item on superdari with the trader and record the same in his report. The inspection should be carried out in such a way that it creates general awareness about the Weights & Measures Laws and Inspecting Officers should clearly outline the deficiencies in the Inspection report and handover one copy of inspection report to the Trader.
- The Zonal Inspectors Gr-II/Gr-III will henceforth make atleast 10 inspections daily of shops/establishment using Weighing & Measuring instruments in their area. The Manual Asstt. may also be asked to accompany them in the area with Standard check weights etc.if required by the ILMs.
- To eliminate complaints regarding sales etc. of non Standard Weights & Measures, henceforth each & every dealer dealing in Weighing & Measuring instruments will be checked monthly by the Zonal Inspector and he will sign the daily Stock Register after verification and shall check sales and purchases of the Weights by such dealers. In the monthly report a certificate to this effect that each & every dealer of Weights & Measures has been inspected is to be submitted by the Zonal Officer to Head Quarter.
- The Zonal Officer will test check at least 5% of such inspections as mentioned as S.No.3&4 above as follow up to ascertain whether necessary corrective steps have been taken or not by the inspector Grade-II & Grade-III.
