Section 24 0f the Standards of Weights & Measures (Enforcement) Act, 1985 prescribes that every person having any weight or measure in his possession, custody or control in circumstances indicating that such weight or measure is being, or is intended or likely to be, used by him in any transaction or for industrial production or for protection, shall get his weight or measure verified before putting such weight or measure in use. This section also casts duty upon the Inspector Legal Metrology (ILM) to verify every weight or measure which is brought to him if he is satisfied that such weight or measure conforms to the standards established by or under the Standards Act and is required to put his stamp there on and issue a certificate in the prescribed form.
Under sub rule 5 of rule 22 of the Delhi Standards of Weights and Measures (Enforcement) Rules 1988 it has been provided that to ensure a proper check of the accuracy of a weighing instrument the user shall keep at the site of each weighing instrument duly verified and stamped weights equal to one tenth of the capacity of the instrument or one tonne, which ever is less with some exceptions if the number of weighing instruments is more than one in any trade premises.
At present it is not practicable for ILMs of the Weights & Measures Department to inspect each premises of the users and there fore all ILMs should ensure to verify if the user of such weighing instrument has required weights or not at the time of verification and stamping of the weighing instrument. This can be done even by perusing the Verification Certificate issued by the Department.
Hence forth all the VCs to be issued to any user for any weighing instrument the ILMs shall make invariably note of the fact that the user has the required number of weights as prescribed in sub rule 5 of rule 22 of the Delhi Standards of Weights and Measures (Enforcement) Rules 1988 by making entry of VC no. and date of VC of Weights in the VC to be issued for weighing instrument and keeping a photo copy of such VC on record along with the office copy of VC being issued.
While issuing the VC the ILMs should also mention (1) the name of manufacturer of weighing instruments and (2) model approval number so that no VC could be issued where the required model approval has not been obtained by the manufacturer. However, where model approval is not required, word “NA” should be mentioned against model approval number.
The action taken in this regard shall also be monitored at HQ and there fore all the Zonal Officers are advised to send fortnightly report to HQ specifying a) total VCs issued; b) number of VCs issued where user had already the required number of weights; c) number of VCs issued where user had purchased new weights as required under rule 22 (5) for the first time and d) any other relevant information Zonal Officers may like to give.
