Under the Standards of Weights & Measures (Enf) Act 1985 (herein after referred to as Enforcement Act, 1985) vide Section 24 every person having any weight or measure in his possession, custody or control in circumstances indicating that such weight or measure is being, or is intended or likely to be, used by him in any transactions or for industrial production or for protection is required to have such weight or measure verified from the department before putting such weight or measure into such use. These weights or measures are also required to be reverified at periodical intervals as prescribed.
The Inspector, Legal Metrology (ILM) who verifies such weights or measures and puts his stamp on such weight or measure is also required to issue a verification certificate (VC) as per provisions of sub section 4 of sec 24 of the Enforcement Act 1985.
Again as per provisions of Section 25 of the Enforcement Act 1985 every certificate of verification granted under this Act is required to be displayed in a conspicuous place in the premises where such weight or measure is being or is intended or likely to be used in any transaction or for industrial production or for protection.
In view of the above provisions of the Enforcement Act 1985 it is the duty of all the ILMs to issue a verification Certificate for each weight or measure or for a particular series of weights as provided in Schedule V of the Standards of Weights & Measures (General) Rules 1987 (herein after referred to as General Rules 1987) so that the user of such weight or measure could display such certificate as required under Section 25 of the Enforcement Act 1985.
It has been brought to my notice that when such weight or measure or a particular series of weight is brought for verification / stamping by the dealers / manufacturers before the ILMs some of them are reportedly issuing only a single verification certificate (VC) for all items which is in violation of above provisions of Section 24 and 25 of the Enforcement Act 1985. All the ILMs are advised to follow the provisions of the Weights & Measures Laws scrupulously and start issuing separate verification certificates with immediate effect for each weight or measure of a particular/series of weights as provides under General Rules 1987.
ILMs may issue verification certificates after either putting signature in original / and official seal on the photocopies of such verification certificates or may issue as many numbers of the attested verification certificate as the number of weight or measure verified.
These instructions shall also be applied in the case of re-verification in the same manner when brought by repairers.
A copy of this circular may also be sent to each dealer / manufacturer / repairer of the Zone by the Zonal Officers.
